- You own the content you create; we own the code and templates that render the site.
1. Parties and scope of service
These terms form an agreement between you (“the user”) and บริษัท ซูเปอร์เดฟ จำกัด (Superdev Co., Ltd.) (เลขที่ 89 รามคำแหง 82 แขวงหัวหมาก เขตบางกะปิ กรุงเทพมหานคร 10240, tax ID 0105563058564), the provider of HugWeb (“we”/“us”). By subscribing to the service or accessing the system, you accept these terms in full.
HugWeb is an AI-powered static business-website builder for Thai SMBs. Its purpose is to get your website ranking on Google and to funnel visitors out to the sales channels you already use (LINE, Shopee, Lazada, TikTok, Instagram, Facebook, phone, Maps). The service has no shopping cart, no payment on the published website, and no product database.
2. Subscription plans and pricing
The service is offered as a prepaid subscription billed per cycle, with several plans to choose from depending on how many websites you need to manage. The price, website quota, and details of each plan actually on offer are shown on the pricing page and at checkout at the time you subscribe. Every new user receives a free trial for the period set by the system at signup (shown clearly on the signup page).
We may change prices or plan details in future. We will notify you in advance before any change takes effect on your next billing cycle. Amounts you have already paid for the current cycle will not be changed retroactively.
3. Payment and renewal
Payments are processed through the payment provider PaySo (Pay Solutions). If the system offers automatic renewal on a saved card, you will be notified in advance before the next charge, and you can cancel automatic renewal at any time before the next cycle from your account settings.
If an invoice is not paid within the grace period set by the system, your website will be temporarily unpublished (reverted to draft — no data is deleted) until your payment status returns to normal.
4. Refund and cancellation terms
HugWeb grants access to the service immediately upon completion of payment. The Company reserves the right to give no refund under any circumstances, for any reason whatsoever, including but not limited to cancellation before the end of a billing cycle, non-use of the service, partial use of a cycle, upgrading or downgrading a plan, or dissatisfaction with the service.
You may cancel your subscription at any time from your account settings. Cancellation stops billing from the next cycle onward; you keep access until the end of the cycle you have already paid for.
Payments made by credit card
For payments made by credit card, the no-refund policy above applies equally, whether the charge is a regular cycle charge or any other kind. The Company will not refund or reverse a charge that has already been made, except where it results from a genuine system error (for example, a duplicate charge, or a charge taken after you had already cancelled the service). Please report such cases to us at [email protected] so we can investigate and put them right.
Service disruption or temporary unavailability
Because HugWeb is priced at an economical rate, the Company accepts no liability and gives no refund or compensation of any kind if the system fails, is temporarily unavailable, or is affected by force majeure. The Company will work to fix and restore the system as quickly as possible, but is not liable for any damage arising from such an interruption.
5. Your obligations as a data controller
When you enable a contact form or any feature that collects visitor data on a website you publish through this service, you are the data controller for that visitor data under the PDPA, while HugWeb acts solely as a data processor on your instructions.
You agree that:
- It is your responsibility to publish a privacy policy for the visitors of your own website and to comply with the PDPA as a data controller.
- Responding to data-subject requests from your website's visitors (access, deletion, correction) is your responsibility — HugWeb will provide the tools and information needed to support those requests, acting on your instructions.
- You will not use the service to collect personal data unlawfully or beyond what your business genuinely needs.
6. Intellectual property
The content you enter or upload (text, your own images, business information) remains yours. The code, section templates, and rendering system used to build the website are the intellectual property of HugWeb. Subscribing grants you the right to use that system for as long as your subscription is active; it does not transfer ownership of the code or templates.
7. Limitation of liability
We work to keep the service running continuously and securely, but we do not warrant that it will be error-free at all times. We are not liable for indirect damages, lost business opportunity, or damages exceeding the amount you paid us during the relevant period, except where the law provides otherwise.
8. Suspension or termination of an account
We may suspend or terminate your account if we find the service being used unlawfully, in breach of these terms, without payment when due, or in a way that harms the system or other users.
9. Governing law
These terms are governed by Thai law, and the Thai courts have jurisdiction over any related dispute.
10. Changes to these terms
When we make a material change to these terms, we will notify you by email or by an in-app announcement before it takes effect. Continuing to use the service after that constitutes acceptance of the new terms.
